Last month Washington State University filed a lawsuit in federal court against a Yakima grower for allegedly infringing on its patent of an apple.  The apple at the center of this controversy is WA-2.  WSU claimed in the January 22nd filing that Pro Orchard Management along with Apple King grew and sold the variety, commonly known as Sunrise Magic without a license.  The suit alleges the companies also sold budwood without permission as well.

This isn’t the first time WSU has sued to protect its apple patents.  Two years ago, the university sued Phytelligence for allegedly infringing on its patent of WA-38, better known as Cosmic Crisp.
