
Ag Building Bill Clears Idaho House, Heads To Senate
By a 70-0 vote Tuesday, the Idaho House approved House Bill 104, which provides a unified and singular definition for agricultural buildings in the section of state code dealing with building permits. Dex Lake with the Idaho Farm Bureau Federation said state law does not require building permits for ag buildings and only requires compliance with road setback specifications and utility easements. He added the legislation prevents counties from inconsistently classifying agricultural structures as commercial or industrial.
"House Bill 104 defines agricultural buildings to include livestock shelters, equipment and machinery storage, horticultural structures and sheds, grain silos and stables. However, the bill does not apply to buildings used for human habitation, facilities for processing, treating or packaging, agricultural products, or any structure open to the public.”
HB 104 now moves to the Senate for consideration.
