
Idaho Lawmakers Ask Feds To Honor Sackett
Last week, Idaho lawmakers adopted a Memorial urging federal agencies to fully respect the limits on federal water regulation established by the Supreme Court’s Sackett decision.
House Joint Memorial 13 highlights the issue of what supporters call uncertainty and overreach in how the federal government defines WOTUS under the Clean Water Act. Despite the High Court’s 2023 ruling limiting WOTUS, landowners across Idaho have reported federal employees continue to apply the outdated interpretations.
“House Joint Memorial 13 urges agencies like the EPA and the United States Army Corps of Engineers to fully implement the court's ruling and stop asserting authority over features such as ephemeral streams, drainage ditches, canals, and stock water ponds that do not meet the court's definition of federally regulated waters,” said Dexton Lake with the Idaho Farm Bureau Federation.
State Also Wants Congress To Act
Lake noted the Memorial also encourages Congress to codify the Sackett standard into federal law to prevent future regulatory overreach.
